1. Acceptance of Terms
By accessing or using BetterMenu ("the App") provided by Hahatone ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App. You acknowledge that this agreement is concluded between you and Hahatone only.
2. Description of Service
BetterMenu is a mobile application that uses artificial intelligence to scan and analyze restaurant menus, providing users with dish information, translations, and AI-generated images of menu items. The App relies on third-party large language model (LLM) providers and image generation services to deliver its core functionality.
3. Data Collection and Processing
By using the App, you acknowledge and agree that:
- Photos of menus you capture or upload are sent to third-party AI and LLM service providers for processing, analysis, text recognition, and image generation
- Your location data, device information, usage patterns, and interaction history may be collected, stored, and processed
- All data collected — including images, text, metadata, and derived content — may be stored indefinitely on our servers and/or third-party cloud infrastructure
- Aggregated and anonymized data may be used for analytics, research, and product improvement purposes
4. Third-Party Services
The App integrates with and transmits user data to third-party services including, but not limited to:
- Google Gemini API — menu photos and location data may be sent to Google's Gemini API for text analysis, translation, restaurant identification, and content generation. Governed by the Google AI Terms of Service and Google's Privacy Policy
- AI image generation services for creating visual representations of menu items
- Cloud storage and computing providers for data storage and processing
- Analytics and crash reporting services
These third-party services operate under their own terms of service and privacy policies. By using the App, you consent to your data being processed by these services. We do not guarantee the security practices or data handling procedures of third-party providers and are not liable for any data breaches or misuse by such providers.
You must comply with applicable third-party terms of agreement when using the App. For example, you must not violate any wireless data service agreement with your mobile carrier when using the App.
Your data, including photos and embedded metadata (such as GPS coordinates), may be transferred to and processed in countries outside your country of residence — including the United States, where Google's infrastructure is located. Such countries may have different data protection standards than your own. By using the App, you acknowledge and consent to this international transfer of your data.
5. User Responsibilities
You agree to:
- Use the App only for lawful purposes
- Not misuse or attempt to reverse-engineer the App
- Not use the App to infringe on intellectual property rights
- Not upload content that violates any laws or third-party rights
- Provide accurate information when required
- Not upload photos that contain identifiable individuals or sensitive personal information belonging to third parties, and ensure you have the right to upload any content you submit
6. Legal Compliance
By using the App, you represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
7. Intellectual Property
All content, features, and functionality of the App are owned by Hahatone and are protected by international copyright, trademark, and other intellectual property laws. AI-generated images and content produced by the App remain the property of Hahatone. You are granted a limited, non-exclusive, non-transferable license to use the App on any devices that you own or control, for personal, non-commercial purposes only.
By uploading photos or other content to the App, you grant Hahatone a non-exclusive, worldwide, royalty-free license to store, transmit, and process such content solely for the purpose of providing the App's services to you. This license terminates when you delete your account or the relevant content.
8. AI-Generated Content Disclaimer
The App uses AI to generate dish images, translations, and menu analysis. While we strive for accuracy, AI-generated content may not always be perfectly accurate or representative of actual dishes. Users should always verify important information — especially regarding allergens, dietary restrictions, ingredients, and nutritional content — directly with restaurant staff. Hahatone bears no responsibility for decisions made based on AI-generated content.
9. Maintenance and Support
Hahatone is solely responsible for providing any maintenance and support services with respect to the App, as specified in these Terms or as required under applicable law.
10. Warranty
Hahatone is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. The App is provided "as is" and "as available" without warranties of any kind, express or implied.
11. Product Claims
You acknowledge that Hahatone is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of the App, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Hahatone shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to damages arising from: inaccurate AI-generated content, data transmitted to or processed by third-party services, loss of data, unauthorized access to your data, or service interruptions.
13. Changes to Terms
We reserve the right to modify these terms at any time. For significant changes — including changes to data collection, data sharing, or user rights — we will provide at least 30 days' notice via the App or email before the changes take effect. For minor or non-material changes, updates take effect immediately upon posting. Continued use of the App after changes take effect constitutes acceptance of the updated terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Hahatone is registered, without regard to its conflict of law provisions.
15. Third-Party Beneficiary
You acknowledge and agree that Apple Inc. and Apple's subsidiaries are third-party beneficiaries of these Terms of Service. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
